Terms of service

By using Trigunatita you agree to these terms. They describe what we promise, what you agree to, how payment works, and how the relationship ends if it has to. Nothing here is a trick; we’ve tried to write it the way we’d want to read it.

1. Parties

This agreement is between you (“you”, “your”, “Customer”) and Trigunatita Technologies (“Trigunatita”, “we”, “us”, “our”), a company registered in India. If you are accepting these terms on behalf of a company, you confirm that you are authorised to bind that company.

2. What Trigunatita does

Trigunatita is a SaaS product that, on your instruction and with your Google OAuth consent, publishes videos you upload to your primary YouTube channel and mirrors them privately to a backup YouTube channel on a separate Google account you own. We also retain an encrypted copy of the original source file in off-YouTube cold storage, for the retention period associated with your subscription tier.

Trigunatita is not affiliated with, endorsed by, or sponsored by YouTube LLC or Google LLC. The YouTube Data API v3 is used in accordance with YouTube’s API Services Terms of Service.

3. Your account

  1. You must be at least 18 years old to create an account.
  2. You must provide accurate information and keep it current.
  3. You are responsible for every action taken under your account, including by anyone you authorise as a team member.
  4. You must connect only Google accounts and YouTube channels you lawfully own or are authorised to manage.
  5. You must not share your login credentials. Use team seats (Pro and Studio tiers) to give access to collaborators.

4. Acceptable use

You may not use Trigunatita to:

  • Upload or mirror content you do not have the right to publish.
  • Upload content that violates applicable law (including Indian IT Act, 2000; Copyright Act, 1957; and comparable foreign statutes), YouTube’s Community Guidelines, or third-party rights.
  • Circumvent a prior YouTube termination by using Trigunatita to re-upload content that YouTube has definitively removed for a policy violation.
  • Reverse-engineer, probe, or stress-test the service without written permission.
  • Use the service to build a competing product — including by copying our UI, documentation, or internal architecture.
  • Attempt to access data belonging to another customer.
  • Use the service in a way that materially degrades performance for other customers.

We may suspend or terminate your account for material breach. Where feasible, we will give you notice and a chance to fix the issue first.

5. Your content

You retain all rights to the videos, thumbnails, metadata, and other content you upload (“Customer Content”). You grant Trigunatita a limited, non-exclusive, worldwide, royalty-free license to host, transmit, copy, and publish Customer Content solely for the purpose of providing the service to you. This license ends when you delete the content or close your account, except where we are legally required to retain copies (e.g., an active legal hold).

We do not use Customer Content to train AI models, to display to other customers, or for any marketing purpose, ever. Full stop.

6. Service levels and limits

6.1 Uptime

We target 99.5% monthly uptime for the upload, mirror, and archive pipelines. Downtime excludes scheduled maintenance (announced at least 48 hours in advance) and force majeure. If we miss this target in a given month, credit will be issued as described in Section 11.

6.2 Restore SLA

For Creator and Pro tiers: restore from cold archive within 12 hours of a valid request. For Studio tier: prioritised restore within 12 hours, usually completed in minutes. If we miss a committed restore SLA on a bona-fide disaster-recovery request, the next invoice is credited 100%.

6.3 Volume limits

Each subscription tier includes a monthly video limit (see Pricing). Uploads beyond the limit are paused (Creator, Pro) or metered (Studio, at ₹60 per additional video). We will email you when you reach 80% of your limit.

6.4 YouTube API dependency

The service is wholly dependent on the YouTube Data API. If Google changes, restricts, or suspends API access in ways outside our control, some functionality may be impaired. We will communicate transparently about any such disruption and will pro-rate charges if the disruption is material and prolonged (over 7 consecutive days).

7. Payment and billing

7.1 Fees

Current fees are published at /pricing. All fees are in Indian Rupees (INR) and inclusive of 18% GST where applicable. International customers are billed the same INR amount; their card issuer converts to local currency.

7.2 Billing cycle

Monthly subscriptions are billed in advance each calendar month. Annual subscriptions are billed in advance once per year, with a 15%-20% discount applied automatically. Payments are processed by Razorpay Software Pvt. Ltd. under its own terms of service.

7.3 Taxes

Fees are exclusive of any withholding taxes, import taxes, or other governmental charges imposed on you. If any such tax is required to be withheld, you must gross-up the payment so that we receive the full fee after withholding.

7.4 Overdue payments

If a payment fails, we will retry for 7 days and email you. If still unpaid after 14 days, we may suspend the service (uploads paused; existing archive remains readable). After 30 days of non-payment we may terminate the subscription. Re-activation fees apply at our discretion.

7.5 Refunds

  • Annual plans — 30-day money-back guarantee. Request a refund within 30 days of first payment and we’ll refund the full year.
  • Monthly plans — no pro-rated refunds. Cancel any time; you retain access until the end of the current billing period.
  • Mid-subscription termination by us — if we terminate your account for a reason other than your material breach, we refund the unused portion.

8. Intellectual property

Trigunatita owns the service, its code, design, documentation, trademarks, and brand. These terms do not grant you any rights to the Trigunatita IP beyond your limited right to use the service. You own your Customer Content (see Section 5).

9. Privacy and security

Our handling of personal data is governed by the Privacy Policy. For business customers requiring a formal processing agreement, the Data Processing Addendum is incorporated into these terms by reference. Our security posture is described at /security.

10. Confidentiality

Each party will protect the other’s confidential information with the same care it takes with its own, and not less than reasonable care. Customer Content and account information are your confidential information. Our service pricing, internal architecture, and non-public roadmap are ours.

11. Warranties and liability

11.1 Our commitment

We commit to providing the service with reasonable care and skill, consistent with generally accepted industry practice for SaaS products of similar scope. We do not warrant that the service will be uninterrupted, error-free, or that it will meet your specific needs beyond what’s described in these terms.

11.2 Disclaimers

Except for the express warranties above, the service is provided “as is.” We disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

Specifically: Trigunatita does not and cannot prevent YouTube from terminating your channel. The product insures against the content-loss consequences of termination; it does not change the probability of termination.

11.3 Limitation of liability

To the maximum extent permitted by law, neither party’s aggregate liability under this agreement (whether in contract, tort, or otherwise) will exceed the fees you paid to Trigunatita in the 12 months immediately preceding the event giving rise to the claim.

Neither party is liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost goodwill, or lost data beyond what Trigunatita’s own backup obligations address.

11.4 Service credits as sole remedy

For missed uptime or restore SLAs, service credits (as described in Section 6 and thePricing page) are your sole and exclusive remedy.

12. Indemnities

You will indemnify and hold Trigunatita harmless from third-party claims arising out of: (a) Customer Content infringing a third party’s rights; (b) your breach of these terms; or (c) your violation of applicable law.

We will indemnify and hold you harmless from third-party claims that the service, as delivered by us and used as intended, infringes that party’s intellectual property rights. This is subject to the liability cap in Section 11.3.

13. Suspension and termination

You can cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. Your cold archive remains readable for 30 days after cancellation so you can export it.

We may suspend or terminate your account for: material breach of these terms; non-payment (per Section 7.4); or a valid legal requirement. We will provide notice unless notice itself would violate law or cause immediate harm.

Sections that by their nature should survive termination (payment obligations accrued, IP, confidentiality, disclaimers, liability limits, indemnities, governing law) do survive.

14. Changes to the service

We may change the service over time. For material reductions in functionality on a current tier, we will give at least 30 days’ notice. For security or legal fixes, changes may be immediate.

15. Changes to these terms

We may update these terms. Material changes will be notified by email at least 30 days before taking effect. Your continued use after the effective date constitutes acceptance. If you object, you may cancel and receive a pro-rated refund of any unused annual subscription.

16. Governing law and disputes

This agreement is governed by the laws of India. Courts in [city to be finalised on incorporation], India have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its IP or confidential information.

Before filing a claim, the parties agree to attempt good-faith resolution by email or video call for at least 30 days. For Customer Content disputes, the grievance officer process (Privacy Policy) applies first.

17. Miscellaneous

  • Entire agreement — these terms, plus the Privacy Policy, DPA (if applicable), and any order form, are the entire agreement.
  • Severability — if any provision is unenforceable, the rest remains in force.
  • No waiver — failure to enforce a right is not a waiver of it.
  • Assignment — you may not assign without our consent; we may assign to an acquirer or successor in a corporate transaction on written notice.
  • Notices — to you at the email on your account; to us at legal@trigunatita.com.
  • Force majeure — neither party is liable for delays or failures due to events outside its reasonable control.
